Quoted Prices
Any quotations provided by an authorized Emery Industries associate shall remain in effect for Sixty (60) days from the original date listed on the quotation unless otherwise noted within the quotation. All quotations are subject to credit approval prior to acceptance by Emery Industries.
Payment
Orders are invoiced at the time of shipment when accompanied by a Purchase Order or at time of receipt for COD customers. Payment terms are as negotiated. An administration charge of one (1%) percent per month can be applied to all obligations not paid according to the terms and conditions herein. In the event the account is turned over to an attorney or other agency for collection, purchaser shall pay all reasonable collection fees, attorney fees and court cost incurred by the seller.
Lead Time
Standard Emery Stainless Steel products are available 30 days from receipt of order. Custom (non-standard) Emery orders are typically available 45 days, unless special arrangements have been agreed upon by an Emery Industries representative.
Overseas Brands: Waterloo and MediMesh if in stock 1 week, if out of stock (worst case scenario) Waterloo- 12-14 weeks or MediMesh products 6-8 weeks.
Projects: Lead time for projects will be as per the agreed delivery schedule.
Freight and Handling
Freight and Handling charges apply unless otherwise stated.
Returns Policy
Emery Industries has a “no returns policy” for any custom or imported products and reserves the right to not accept standard product returns that have been manufactured. If a return is accepted, then a restocking fee of 20% applies.
Damaged Shipments
It is the purchaser’s responsibility to examine products upon delivery. Any visible damage must be noted on the carrier’s proof of delivery docket. If there is visible damage to the product upon arrival, the customer is instructed to refuse delivery of the damaged product. Failure by the purchaser to make any claim against the company within 24 hours of receipt of the product shall constitute acceptance of the products and a waiver of product damages or shortages.
Cancellations
Order change and cancellation requests will be handled on a case-by-case basis. A change or cancellation fee may be incurred up to the full order value. This fee is determined by the percentage of the order completed at the time of cancellation.
10 Year Workmanship Guarantee
Emery Industries is proud to stand behind our products, and in support of this, we are now offering a 10 Year Workmanship Guarantee for all our Emery Stainless Steel products that are manufactured in-house at Arundel on the Gold Coast.
Trademark Protection and Recognition
Emery Industries is a registered trademark in Australia. This trademark represents the integrity, quality, and innovative excellence of our products and services across the healthcare sector. As such, any unauthorised use, replication, or modification of the Emery Industries name, logo, or any distinctive brand elements is strictly prohibited.
The following additions apply to our existing Intellectual Property Protection Policy:
- Trademark Registration and Enforcement: The “Emery Industries” trademark is legally registered and protected under Australian law. The Company will take all necessary steps, including legal enforcement, to protect the use of its trademark and prevent brand misrepresentation or infringement.
- Third-Party Use of Trademark: Customers, resellers, or any third parties must obtain express written consent from Emery Industries to use the Company’s trademark or logo in any marketing, promotional, or sales material. Any unauthorised usage may result in immediate legal action.
- Brand Integrity: The trademark signifies the Company’s commitment to innovation, compliance, and Australian manufacturing quality. Emery Industries reserves the right to revoke any prior permissions granted for trademark use if it is found to compromise the integrity or reputation of the brand.
